Texas Dental Malpractice

Dental malpractice insurance for Texas dentists

Texas is one of the fastest-growing dental markets in the country, from solo practices to some of the largest DSOs. DentistryInsured is a dental specialty program of Emery & Webb, Inc., an independent agency, and Texas is one of our largest states. We compare coverage from multiple A-rated carriers to find the right fit for associates, owners, oral surgeons and multi-location groups.

How Texas law shapes your malpractice coverage

Texas tort reform caps non-economic damages in health care liability claims, including claims against dentists, at $250,000 per claimant against individual providers. Plaintiffs must also serve an expert report early in the case, which screens out many weak claims.

That doesn't mean Texas dentists can skimp on coverage. Economic damages such as medical costs and lost earnings aren't capped, defense costs add up fast, and complaints to the Texas State Board of Dental Examiners (TSBDE) can threaten your license even when no lawsuit is filed. We typically recommend that Texas dentists:

  • Carry limits of at least $1M / $3M, or higher for surgical, implant or sedation work
  • Choose defense costs outside the limits
  • Keep consent-to-settle language
  • Add license protection for TSBDE complaints and investigations, the most common threat Texas dentists face

What we place for Texas dentists

  • Dental malpractice (professional liability): claims-made or occurrence, $1M / $3M and higher
  • License protection and TSBDE defense
  • Office / business owners policy (BOP), including coverage that accounts for wind, hail and storm exposure
  • Cyber liability for patient records, ransomware and breach response
  • Workers' compensation (optional for most Texas employers, but strongly recommended for dental practices)
  • Employment practices liability (EPLI)
  • Umbrella liability

FAQ

Texas dental malpractice questions

How much does dental malpractice insurance cost in Texas?

+
Texas premiums are often lower than in states like New Jersey or New York, thanks in part to tort reform. Your rate still depends on specialty, limits, claims history and policy type. Request a quote and we'll compare options. See what drives the cost.

Does the Texas damages cap mean I need less coverage?

+
Not necessarily. The cap applies to non-economic damages only. Economic damages and defense costs aren't capped, so most dentists still carry at least $1M / $3M.

Does malpractice insurance cover a TSBDE complaint?

+
Only if your policy includes license protection or board defense coverage. Board complaints are among the most common issues Texas dentists face, so we recommend it.

Do Texas dental practices need workers' compensation?

+
Texas is the only state where most private employers can opt out of workers' comp. Practices that opt out lose important legal protections if an employee is injured, so most dental practices should carry it.

Can you cover our whole DSO or group?

+
Yes. We place entity and provider coverage across multiple locations and can issue certificates the same day.
